This week a judge will let a jury decide something pretty fundamental: did social media companies design their apps in ways that hooked kids – and, if so, can the companies be held legally responsible for the mental-health fallout? Meta, TikTok and YouTube are rolling into court in California as the first of what could be a string of landmark trials over claims that platforms’ attention-grabbing features contributed to teen addiction, depression and suicidal thoughts.
The plaintiff is a 19-year-old California woman identified in court papers as K.G.M., who says she became addicted to apps such as Instagram, TikTok and YouTube from a young age. Her lawsuit contends that features engineered to maximize time spent – think infinite scrolls, autoplay, dopamine-friendly notifications and algorithmic recommendations – helped fuel her depression and pushed her into crisis. Jury selection begins this week in Los Angeles County Superior Court, and lawyers on both sides say the outcome could reverberate through thousands of related suits.
At the heart of the case are internal documents and chats that, plaintiffs’ lawyers say, show product teams and executives talking in blunt terms about designing for “engagement” – what critics call a euphemism for addictive product hooks. Reporting and leaked exhibits catalog discussions about how to keep adolescents glued to feeds, optimize for repeat visits and use behavioral-science tricks to boost short-term attention. Defendants argue those same design choices are innocuous tools to improve user experience – and that parents, not corporations, bear most responsibility for children’s screen time.
Those internal memos are a big part of why this case feels different from previous lawsuits. Plaintiffs are not just pointing at content –which historically has been shielded by a federal law that largely protects platforms from liability for what users post – but at the architecture of the apps themselves. If juries accept the argument that companies intentionally engineered features to addict young people, the legal theory could pierce a long-standing shield tech firms have used to fend off liability. That would be a game changer.
Tech giants are piling legal talent and PR muscle into the fight. Meta has said it will vigorously contest the claims; Reuters reports that founder-CEO Mark Zuckerberg is expected to testify, and Snap’s Evan Spiegel was also lined up before his company settled with the plaintiff. YouTube is arguing that its platform differs fundamentally from TikTok and Instagram and should not be lumped into the same box. The companies have also rolled out public-facing safety initiatives – parental controls, time-limit features, school programs – that they point to as proof they’re trying to help.
Plaintiffs and child-safety advocates say those safeguards are often cosmetic and too little, too late. They argue that features rolled out as “safety” can be dull or buried, while the core engagement engines keep humming in the background. The Washington Post’s reporting on the wave of social-media litigation frames the trial as the moment when the court of public opinion and the court of law might finally sync up: parents and lawmakers have been angrier than ever about the effects of social media on young people, and now juries may be asked to make a judgment call on corporate responsibility.
What’s on the line? For plaintiffs, a favorable verdict could open the door for damages and force platforms to rethink features that maximize time online. For tech companies, a loss could expose them to a cascade of liability and undermine a legal framework that has long insulated them from responsibility for user harms. Even if the companies win, the trial will air internal discussions that could sour regulators, lawmakers and the public – and influence policy responses like stricter youth protections or redesign mandates.
Expect the weeks ahead to be heavy on bad-for-tech headlines. Testimony could include engineers and executives explaining product choices; expert witnesses will parse the neuroscience of attention; and jurors will be shown a parade of screenshots and memos that once lived behind paywalls and secrecy agreements. Whether that material persuades twelve ordinary people to hold a multibillion-dollar industry accountable is the dramatic question at the trial’s core.
One other thing to watch: even if this case doesn’t immediately topple tech’s legal defenses, it could steer the conversation – and the policy needle – toward more regulation. Lawmakers in several countries have already mused about limits on addictive design or stricter age verification. A courtroom loss for a major platform would add political momentum to those ideas.
Bottom line: the trial is more than a legal skirmish. It’s a cultural reckoning over whether addictive design is a moral failing that corporations can be made to answer for – or a messy social problem that remains, in the eyes of many tech lawyers, ultimately the responsibility of families and regulators. Either way, the verdict will likely be the start of a new chapter in how we govern, build and use the apps that now crowd so much of young lives.
