A 14-year-old Cheyenne boy is being charged as an adult with first-degree murder after allegedly shooting his mother in the back of the head following an argument over a stolen tablet.
Theresa McIntosh, 34, died Sunday at a Colorado hospital after being airlifted following the March 8 shooting, according to the Laramie County Sheriff’s Office.
Havoc Leone is presumed innocent unless proven guilty.
Deputies responded Saturday to a reported suicide attempt involving a firearm at a Pine Avenue residence in south Cheyenne. McIntosh was found in an upstairs bedroom where she had been doing a puzzle. Medical staff later noted the location of the gunshot wound—above and behind the right ear—was not consistent with suicide attempts.
McIntosh’s common-law husband told investigators he was in the basement playing a video game with noise-canceling headphones when he heard a “pop.” When he went upstairs, Leone appeared panicked and reportedly said, “I don’t know, it just went off.”
The husband said McIntosh and Leone had argued that morning about a tablet Leone had allegedly stolen from one of McIntosh’s cleaning service clients. They had considered calling police about the theft. McIntosh had returned home with donuts around 11 a.m.
A 9mm handgun was found on the bedroom floor. The husband said it belonged to McIntosh and was usually kept in her car. Investigators believe Leone stole the firearm from her vehicle about a week before the shooting following a “big fight” over his math grade.
Bond was set at $500,000.
